Calculate California meal and rest break penalties — the one extra hour of premium pay owed per violation day, what counts as a violation, and what months of missed breaks add up to.

Quick answer: Each day with a meal-break violation = one extra hour of pay at the regular rate; each day with a rest-break violation = another hour (max 2 premium hours/day). A $22/hour worker denied lunch 4 days a week for a year is owed ~$4,576 — before interest and related penalties.

The Break Rules (Labor Code 512 & 226.7)

Shift lengthMeal breaks owedRest breaks owed
3.5-6 hrs—1 × 10 min (paid)
5-10 hrs1 × 30 min unpaid, starting before the end of hour 52 × 10 min
10-12 hrs2 × 30 min (2nd before end of hour 10)3 × 10 min

A violation is: no break, a short break, a late break (first meal starting after hour 5), or an interrupted/on-duty break without a valid agreement. The remedy: one additional hour of pay at the regular rate per day, per violation type — one for meal, one for rest, maximum two premium hours a day.

Worked Examples

Example 1 — the chronic lunch-skipper's employer. $22/hr, lunch denied or taken late 4 days/week × 52 weeks = 208 violation days → $4,576. California's 3-year wage statute (4 via UCL) means multi-year patterns triple that.

Example 2 — meal + rest both. Same days also missing rest breaks: 208 more hours → total $9,152. Meal and rest premiums stack per day; multiple meal violations in one day do not.

Example 3 — the "regular rate" bump. The premium uses the regular rate (with shift differentials and nondiscretionary bonuses folded in) — a 2021 Supreme Court ruling (Ferra) made this retroactive; employers who paid base-rate premiums owe the difference.

What Makes a Break Legally Valid

  • Duty-free and uninterrupted — answering radios or staying "available" invalidates it.
  • Timely — first meal must begin before the end of the 5th hour; late = violation even if taken.
  • Relinquished control — employees may leave the premises for meals.
  • Waivers: shifts ≤6 hours can waive the meal by mutual consent; the second meal is waivable on ≤12-hour shifts if the first was taken.

Claiming the Premiums

  1. Reconstruct the days: timecards showing no 30-min gap before hour 5 are the standard evidence — courts accept employee logs where records are missing.
  2. Payroll check: premiums already paid show as "meal premium" lines; many employers auto-pay on flagged punches — absence of ANY premium lines at a busy workplace is itself a red flag.
  3. Escalation: internal payroll → Labor Commissioner wage claim (free) → PAGA/class routes for systemic patterns. Premiums are wages: unpaid ones ride along in waiting time penalty math at termination and standard back pay claims.

For Employers: Containment

Schedule meals to START by hour 4.5 (buffer), make punch systems flag missed/late/short meals and auto-pay the premium the same period, train supervisors that "working lunch" = violation, and get written waivers where lawful. The premium is cheap; the class action over a uniform policy is not — most eight-figure California wage settlements are break cases.

Frequently Asked Questions

What is the California meal penalty?

One extra hour of pay at the regular rate for each workday with a meal-break violation — missed, short, late (starting after hour 5), or interrupted breaks all count.

How much is the rest break penalty?

Also one hour of regular-rate pay per day with rest violations — stacking with the meal premium for a maximum of two premium hours per day.

When must a meal break start in California?

Before the end of the 5th hour of work (and a second meal before the end of the 10th on long shifts). A late start is a violation even if the break is taken.

Is the break premium paid at base rate?

No — at the REGULAR rate including shift differentials and nondiscretionary bonuses (Ferra v. Loews, applied retroactively).

How far back can I claim meal penalties?

Three years as wages (effectively four via unfair-competition claims). Chronic patterns accumulate fast at one hour per day.

Can I waive my California meal break?

Only by mutual consent on shifts of 6 hours or less (and the second meal on ≤12-hour shifts if the first was taken). Blanket "we skip lunches here" policies are mass violations.
