Calculate Philippine overtime — Labor Code premiums: +25% of the hourly rate beyond 8 hours on ordinary days, +30% on rest days/special days/holidays (stacking ON those days’ premium rates), plus night-differential compounding.
Quick answer: PH overtime: hourly rate × 125% for hours past 8 on ordinary days. On premium days the 30% OT loading applies to that day’s rate: rest day OT = 130% × 130% = 169%; regular-holiday OT = 200% × 130% = 260% per hour. Night hours (10pm-6am) compound another 10%.
The Premium Grid
| Day | Day rate | OT rate (per hour past 8) |
|---|---|---|
| Ordinary | 100% | 125% |
| Rest day / special non-working day | 130% | 130% × 130% = 169% |
| Special day falling on rest day | 150% | 195% |
| Regular holiday | 200% | 200% × 130% = 260% |
| Regular holiday + rest day | 260% | 338% |
Hourly rate = daily ÷ 8. Night differential (+10% of the applicable rate) compounds on 10pm-6am hours — a holiday-rest-day night OT hour reaches 371.8%, the Labor Code’s ceiling stack.
Worked Example
₱645 daily (₱80.63/hr), 2 OT hours ordinary day: 2 × 80.63 × 1.25 = ₱201.56. Same 2 hours on a regular holiday: 2 × 80.63 × 2.6 = ₱419.25. With both hours past 10pm: × 1.1 → ₱461.18.
Who’s Covered
Rank-and-file regardless of pay method; EXEMPT: managerial staff, field personnel with unsupervised hours, kasambahay (separate law), and family members dependent on the employer. "Offsetting" OT with undertime on another day is prohibited — undertime deducts, OT pays, separately.
Claims
Money claims run 3 years back via DOLE regional offices (SEnA conciliation first) — time records, biometrics logs, and chat instructions evidence the hours. The compounding map lives on three related pages: night differential, rest-day premiums, holiday pay.
Frequently Asked Questions
How is overtime computed in the Philippines?
Hourly rate (daily ÷ 8) × 125% past 8 hours on ordinary days; on rest days/holidays the 30% OT loading multiplies that day’s premium rate (169%-338%).
Does night differential stack with overtime?
Yes — +10% of the applicable OT rate for hours between 10pm and 6am; the premiums compound, not add.
Can undertime offset overtime?
No — Article 88 prohibits offsetting; undertime deducts at the regular rate while OT pays at premium, separately.
Who is exempt from overtime pay?
Managerial employees, officers whose primary duty is management, field personnel with unsupervisable hours, and kasambahay (covered by their own law).
How far back can I claim unpaid OT?
Three years from each underpayment via DOLE/NLRC — time records and electronic logs carry the claim.
