Calculate Ontario termination pay — the ESA notice ladder (1-8 weeks), pay in lieu, benefit continuation, and the mass-termination rules that change everything.

Quick answer: Ontario ESA termination notice/pay: 1 week after 3 months, then 1 week per year of service up to 8 weeks — given as working notice, pay in lieu, or a mix. Benefits must continue through the notice period. This is the floor; common-law notice is usually several times larger.

The ESA Notice Ladder

Under 3 monthsNone (ESA)
3 months - 1 year1 week
1-3 years2 weeks
3-4 years3 weeks
4-5 years4 weeks
5-6 years5 weeks
6-7 years6 weeks
7-8 years7 weeks
8+ years8 weeks (ESA max)

During statutory notice (worked or paid): wages at the regular rate, benefits continued, and vacation accruing. Long-service employees at larger employers stack ESA severance (up to 26 more weeks) on top.

Worked Examples

Example 1. 6 years, $1,400/week, walked out same day: 6 weeks = $8,400 pay in lieu + 6 weeks of benefit continuation + vacation pay accrual on it.

Example 2 — mass termination override. 50+ employees terminated in 4 weeks at one establishment: the ladder is replaced by 8/12/16 weeks (by headcount) for EVERYONE — a 6-month hire in a 200-person layoff gets 12-16 weeks, not 1.

Example 3 — the common-law multiplier. Same 6-year employee, age 52, specialized role, no enforceable termination clause: courts could assess 6-9 months. The ESA figure is the floor the employer must pay unconditionally; everything above is negotiation/litigation territory.

What Voids or Varies It

  • Wilful misconduct (a high bar — mere poor performance does NOT qualify) eliminates ESA notice.
  • Fixed-term contracts ending on schedule owe nothing — but early termination of a fixed term can owe the whole remaining term.
  • Constructive dismissal (big unilateral changes: pay cuts, demotions, forced relocation) triggers the same entitlements as firing.
  • Temporary layoffs beyond ESA limits (13 weeks in 20, or 35 in 52 with benefits) convert into termination automatically.

Pay in Lieu Mechanics

Lump sum = notice weeks × regular wages (12-week average for variable pay), paid within 7 days or next payday, with vacation pay on top and benefits maintained for the period. Employers who cut benefits during notice owe damages — insurers denying a claim in that window creates the nightmare scenario courts punish.

Strategy for Employees

ESA amounts are unconditional — never sign a release to receive them. The release is for the common-law delta: before signing, check your contract's termination clause against current case law (many fail), quantify the EI delay the package causes, and remember mitigation: common-law claims expect a job search, ESA money doesn't. A one-hour legal consult routinely moves these numbers by months of pay.

Frequently Asked Questions

How much termination pay do I get in Ontario?

ESA: 1 week after 3 months of service, then one week per year up to 8 weeks maximum — as working notice, pay in lieu, or a combination, with benefits continued.

Can I be fired without notice in Ontario?

Only for wilful misconduct (a deliberately bad-faith standard, not poor performance) — or with full pay in lieu of the notice period.

What are Ontario's mass termination rules?

50+ terminations at one establishment within 4 weeks: everyone gets 8 weeks (50-199), 12 weeks (200-499), or 16 weeks (500+) regardless of tenure, plus Form 1 filing.

Do benefits continue during the notice period?

Yes — through statutory notice whether worked or paid in lieu; cutting them early creates liability well beyond the premiums.

Is termination pay different from severance pay?

Yes — this (max 8 weeks) applies to nearly everyone; ESA severance (max 26 weeks) additionally applies at 5+ years with $2.5M+ payroll employers.

What is constructive dismissal?

A fundamental unilateral change — major pay cut, demotion, relocation — that law treats as termination, triggering the same notice and severance entitlements.
