Calculate Canadian final pay — the exit stack: unpaid wages + vacation pay (4-6%) on ALL vacationable earnings including the termination pay itself + banked overtime + statutory termination/severance — with provincial payment deadlines.
Quick answer: Final pay = wages owed + accrued vacation pay (4% / 6% of vacationable earnings — including on termination pay in Ontario) + banked OT at 1.5x value + ESA termination pay (1 wk/yr to 8) + Ontario severance where applicable. Deadlines: Ontario 7 days/next payday; BC 48 hours (employer-ended) — province-specific.
The Exit Stack
| 1. Wages | Final period + any OT — through the last day |
| 2. Vacation pay | 4%/6% of vacationable earnings not yet paid out — and in Ontario, vacation pay accrues ON termination pay too (the stacking people miss) |
| 3. Banked OT | Cash at the banked value (rules) |
| 4. Termination pay | ESA: 1 week/year to 8 (if no working notice given) |
| 5. Severance (Ontario) | +1 week/year to 26 where 5+ years AND $2.5M payroll |
| 6. The common-law gap | Everything above is the FLOOR — see the notice estimator before signing a release |
Deadlines by Province
Ontario: later of 7 days after termination or the next regular payday; BC: 48 hours when the employer ends it (6 days on quitting); Alberta: varies with notice given (3-10 days); federal: 30 days for Code entitlements. Late final pay is a standards complaint with teeth.
Worked Example
$2,400 wages + 4% on $30,000 vacationable ($1,200) + 4 weeks’ termination ($4,800) + vacation on the termination pay ($192, Ontario) = $8,592 — plus the ROE within 5 calendar days for EI.
Checks Before You Cash It
Vacation on ALL vacationable earnings (commissions and OT included), the severance-eligibility payroll test, benefits continuation through the statutory notice period (they must run), and no release signed before advice — the release converts common-law claims into the cheque in front of you. Deductions need authorization; "equipment not returned" self-help deductions are mostly unlawful.
Frequently Asked Questions
What must final pay include in Canada?
All wages, accrued vacation pay (4-6% of vacationable earnings — including on termination pay in Ontario), banked OT, and statutory termination/severance where owed.
When must final pay arrive?
Province-specific: BC 48 hours (employer termination), Ontario 7 days/next payday, Alberta 3-10 days by notice status — late pay is a standards complaint.
Does vacation pay apply to termination pay?
In Ontario, yes — termination pay is wages for vacation-pay purposes, adding 4-6% on top; commonly missed.
What is the ROE deadline?
Electronic ROEs: 5 calendar days after the pay-period end — EI applications stall without it; complain to Service Canada if late.
Should I sign the release before checking?
No — the statutory stack is owed regardless; releases trade your (often larger) common-law notice claim for the offer. Review first.
