Calculate Singapore notice pay — the EA default scale (1 day to 4 weeks by tenure when the contract is silent), salary in lieu payable by EITHER side, and using annual leave to offset the notice period.
Quick answer: Notice: the CONTRACT governs; if silent, the EA scale — <2 wks service: 1 day; 26 wks-2 yrs: 1 week; 2-5 yrs: 2 weeks; 5+: 4 weeks. Either party may pay salary in lieu (gross rate). Leaving short: you OWE the employer the shortfall — Singapore’s two-way rule.
The Rules
| Source | Contract first; EA defaults when silent (1 day / 1 week / 2 weeks / 4 weeks by tenure bands) |
| Salary in lieu | Either side may end immediately by paying the unserved notice at the GROSS rate — the symmetric right that surprises foreigners |
| Employee leaving short | You owe the employer compensation for the unserved days (deductible from final salary by agreement/set-off) |
| Leave offset | Using annual leave to SHORTEN notice: employment ends earlier, you’re paid to the last day + unused leave; vs taking APPROVED leave DURING notice: employed to the full date (service continuity, AWS/bonus dates!) — different outcomes, choose deliberately |
| During notice | Full pay/benefits; employer can’t force leave consumption unilaterally beyond policy |
Worked Example
1-month notice, $5,000, serving 14 of 30 days: shortfall 16 days → in-lieu owed ≈ 5,000 × 16/30 = $2,667 (by you, if you’re the one leaving early; by them, if they release you). Offsetting 10 leave days instead: serve 14 + offset 10 → owe only 6 days ($1,000) — the leave does double duty.
CPF and Tax Notes
Salary in lieu of notice from the employer: not CPF-able (it’s compensation, not wages) but taxable; employee-paid shortfalls aren’t deductible for them. Final salary timing: last day of employment (resignation with full notice) or within 7 days (other cases).
Tactics
Time resignations after bonus/AWS payment dates (payable-if-employed clauses); negotiate garden-leave releases in writing; and get any waiver of notice documented — verbal "just go" followed by a shortfall deduction is the classic TADM dispute. Related: the incomplete-month formula prices the partial final month.
Frequently Asked Questions
What notice applies if my contract is silent?
The EA defaults: 1 day (under 26 weeks), 1 week (26 weeks-2 years), 2 weeks (2-5 years), 4 weeks (5+ years) — contracts override in either direction.
Can I pay to leave immediately?
Yes — salary in lieu works both ways in Singapore: either party ends employment instantly by paying the unserved notice at the gross rate.
Can annual leave offset notice?
Yes, two different ways: offsetting shortens employment (paid out earlier); approved leave during notice keeps you employed to the end date — bonus/AWS eligibility often decides which is smarter.
Is salary in lieu CPF-able?
Employer-paid in-lieu is not CPF-able (taxable compensation); normal salary during a served notice is.
When is final pay due?
On the last day of employment for a fully served resignation; within 7 days otherwise — late payment goes to TADM.
